PRIVATE MINISTERIAL ASSOCIATIONS

Also known as:

     *     Faith-based Organizations

     *     Spiritual Ministries

     *     Ecclesiastical Associations, meaning they are based upon the Holy Scriptures of the Bible

Private Ministerial Associations are a type or subset of Private Membership Associations and offer the greatest protections to Americans due to the recognition within the Constitution of our God-given right to practice religion.

LEARN MORE HERE ABOUT 508(c)(1)(a) STATUS FOR PRIVATE MINISTERIAL ASSOCIATIONS AND OTHER FAITH-BASED ORGANIZATIONS/ SPIRITUAL MINISTRIES/ ECCLESIASTICAL ASSOCIATIONS, ETC., INCLUDING FINANCIAL PROTECTIONS.

After you have drawn up your founding documents for your PMA, you will need to complete the following steps (if you want a bank account):

     *     Get an EIN number from the IRS: we were instructed to file as a church. Your bylaws should include your 508(c)(1)(a) status designation, otherwise, the IRS automatically will consider your association as a 501(c)(3), and you will be required to file taxes each year.

     *     Set up a bank account for your operations: we were instructed to take our EIN number and bylaws to the bank. They took a copy of both from us, and NO other documents should be required. Keep as much information PRIVATE as possible. All trustees must be present to open an account, otherwise, a document must be signed to designate an individual as capable of conducing business on behalf of the PMA.

     *     Set up a State Sales & Use Tax license: if you will be buying products for re-sale, you can purchase at wholesale without being taxed. Also, this number can be used to request that any real property which you place under a trust for the PMA (with the PMA listed as the beneficiary) be removed from the property tax rolls for your county. This is a form of further protection for assets. David Edwards can help you set up a trust associated with your PMA.
